Terms of Service for OneStarLive

Welcome to OneStarLive. These Terms of Service ("Terms") are an agreement between you and the operator of OneStarLive ("OneStarLive," "we," "us," "our"), and govern your access to and use of the OneStarLive platform — our websites, creator profiles, public event pages, Twitch Extension, panels, overlays, APIs, chat and notification tools, scheduling tools, and related functionality (collectively, the "Service"). Notices to us under these Terms may be sent to contact@onestarlive.com.
By accessing or using the Service — including by creating an Event, using Bits, voting, reacting, or otherwise interacting with the Service — you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1. Definitions
"Broadcaster" means a Twitch channel owner or operator who uses OneStarLive to create, schedule, promote, or run Events.
"Viewer" means any person who interacts with OneStarLive on Twitch, on a shareable event page, on an overlay, or on any other surface — including by using Bits, voting, reacting, marking themselves "going," or attending a live Event.
"Event" means any event created via OneStarLive, including its title, description, category, goal, schedule, images, vote options/outcomes, reactions, and metadata.
"Vote Options / Outcomes" means optional interactive choices associated with an Event that may be displayed to Viewers and influenced by Viewer interactions.
"Bits" means Twitch Bits and any related Twitch mechanism, which is owned and operated entirely by Twitch.
2. Eligibility and Accounts
You must comply with all applicable laws and platform rules (including Twitch's Terms of Service, Developer Agreement, Community Guidelines, and Extension policies) to use the Service. You are responsible for:
- safeguarding access to your Twitch account and any OneStarLive authentication tokens;
- all activity performed through your use of the Service; and
- providing accurate information when requested.
You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use. You must also be old enough to use Twitch in your jurisdiction and meet Twitch's own age requirements. The Service is not directed to children under 13, and we do not knowingly collect their information. We may suspend or terminate access at any time if we believe you have violated these Terms or misused the Service.
3. Relationship to Twitch and Third Parties
OneStarLive is a third-party tool that operates on top of Twitch. OneStarLive is not affiliated with, endorsed by, sponsored by, or operated by Twitch Interactive, Inc.
The Service depends on and integrates with third-party services outside our control, including Twitch (Extension runtime, API, EventSub webhooks, OAuth, chat, schedule, clips, and the entire Bits payment and revenue-share system), Discord (message delivery via a Broadcaster-supplied webhook), and cloud hosting and storage providers.
Your use of Twitch and any other third-party service is governed by that service's own terms and policies. We are not responsible for third-party platforms, outages, downtime, API or feature changes, deprecations, rate limits, moderation or enforcement actions, account suspensions, payment processing, or any act or omission of any third party. If a third party changes or discontinues functionality the Service relies on, features may degrade or stop working, and we are not liable for that.
4. What OneStarLive Does (Service Overview)
OneStarLive is a livestream event platform for Twitch streamers, used on the web and through our Twitch Extension. It is not a payment processor, money transmitter, escrow service, marketplace, gambling product, or broadcaster. Its tools may include:
- creating, scheduling, and displaying Events in Twitch channel panels, overlays, and shareable event pages;
- syncing an Event as a stream segment to the Broadcaster's own Twitch schedule (where the Broadcaster grants the necessary Twitch permission);
- automated chat messages and reminders, sent using the Broadcaster's own Twitch credentials and permissions, where the Broadcaster has opted in;
- delivering notifications to a Broadcaster-supplied Discord webhook, where enabled;
- displaying Bits-goal progress and goal-state transitions that mirror Twitch's own Bits ledger;
- optional Vote Options / Outcomes, reactions, "going" indicators, and opt-in live-attendance entries; and
- public creator profiles, trophies, streaks and a public leaderboard (Section 11);
- public recap pages published for completed Events, carrying clips, video links and Event results; and
- analytics and reporting about a Broadcaster's own Events and engagement.
Features may vary by platform, account, region, or availability, and may be added, changed, or discontinued (see Section 16).
OneStarLive does not guarantee that any Event will reach its goal, be scheduled, start on time, occur as described, or occur at all. The Service records and displays a Broadcaster's *intent* to stream; it does not cause, control, or guarantee that any stream actually happens.
5. Events, Live Features, and Vote Options
5.1 Broadcaster Controls and Discretion
Broadcasters control their own Events and may create, edit, reschedule, mark as missed, or cancel Events at any time, in their sole discretion.
5.2 Feature Limitations
Our live features depend on Twitch and other third-party systems. We do not guarantee that: overlay or panel elements will display for all or any Viewers; chat or Discord messages will function, send, or continue; any particular level of engagement or Bits will occur; or that Twitch will permit a given messaging or feature behavior at any time. Features may be changed, retired, or replaced (see Section 16).
5.3 Vote Options / Outcomes
Vote Options / Outcomes are an engagement feature only. They may reflect preferences, modifiers, or "what chat wants" — they are not a guaranteed deliverable. Unless a Broadcaster expressly and independently promises otherwise, votes and outcomes do not create any contractual obligation on the Broadcaster or on OneStarLive to perform any specific action, cosplay, content, or result. We do not guarantee that any voting mechanic will produce a single winner, produce a feasible or achievable result, reflect all Viewers, or be free from ties, edge cases, or technical error.
6. Bits and Payments
6.1 OneStarLive Never Handles Money
All Bits transactions are processed, held, and settled entirely by Twitch — never by OneStarLive. When a Viewer uses Bits, the transaction and any payout to the Broadcaster occur exclusively through Twitch's native Bits system. OneStarLive does not receive, hold, custody, escrow, transmit, or process any Viewer payments. The Bits progress shown in the Service is an accounting mirror of Twitch's own ledger; no money moves through OneStarLive's systems.
Twitch may pay OneStarLive a developer revenue share associated with Bits used through the Extension — currently 20%. It is paid by Twitch; it is not deducted by us, and no Viewer payment passes through our systems.
6.2 Returns and Reversals (Please Read)
OneStarLive cannot issue refunds. Any refund, reversal, or dispute is governed exclusively by Twitch's policies, and is a matter between you, the Broadcaster, and Twitch.
Nothing about an Event creates an independent right to reimbursement from OneStarLive — including an Event that does not reach its goal, is delayed, modified, or cancelled, has technical problems, or does not happen at all.
6.3 No Wagers, No Gambling
OneStarLive is not a gambling, betting, wagering, sweepstakes, or games-of-chance product. Using Bits is a voluntary platform interaction and does not represent a bet, wager, deposit, investment, or guaranteed exchange of value.
7. No Obligation to Stream; No Broadcaster Performance Guarantee
Broadcasters are not obligated to stream any Event or to deliver any specific content, even if a goal is reached, a schedule is set, or a scheduling feature is unlocked.
OneStarLive is a facilitation and scheduling tool only. We are not responsible for, and do not guarantee, any Broadcaster's decisions, performance, appearance, attendance, punctuality, delays, cancellations, no-shows, content, conduct, quality, or safety. Any expectation a Viewer forms about whether or how a Broadcaster will stream is between the Viewer and the Broadcaster — not OneStarLive.
8. Livestream Incidents and Content Responsibility
8.1 No Responsibility for Livestream Content or Conduct
OneStarLive does not create, control, host, monitor, or moderate livestream content or the conduct of any Broadcaster or Viewer. We are not responsible for any act, omission, incident, dispute, or harm that occurs during, before, after, or in connection with any stream or Event, including without limitation harassment, bullying, hate speech, threats, doxxing, fraud or scams, adult or illegal content, intellectual-property infringement, or any interaction between users.
8.2 No Endorsement
The listing, display, or promotion of any Event through the Service does not constitute an endorsement, verification, or recommendation by OneStarLive. Broadcasters and Viewers are solely responsible for their own conduct, content, and interactions.
9. Communications, Chat Messages, and Automations
The Service can send messages on a Broadcaster's behalf — including Twitch chat announcements, reminders, shoutouts, and Discord webhook posts — triggered by Event lifecycle stages or by Bits used toward a goal, where the Broadcaster has opted in. These messages are sent using the Broadcaster's own Twitch credentials, permissions, and Discord webhook; the Broadcaster is responsible for the content and for compliance with all platform rules and laws.
You acknowledge that such messaging may fail, be delayed, be throttled, be rate-limited, or be disallowed or removed by Twitch, Discord, or other platforms at any time; that OneStarLive is not responsible for chat moderation outcomes, enforcement actions, or deliverability; and that you remain solely responsible for ensuring your channel, messaging, and automations comply with all applicable platform rules and laws.
Some destinations may appear as configuration options before the corresponding delivery is available. We make no promise that any particular automation destination is active, and we may add, change, or remove destinations at any time.
10. Viewer Data and Interactions
To operate the Service, we collect and store limited data about Viewers who interact with Events — such as a Viewer's Twitch identifier, display name, avatar, Bits and vote records, "going" status and reactions, and opt-in live-attendance entries. Attendance is not recorded unless a Viewer chooses to be counted; a Viewer who has not opted in is not recorded. Viewers can ask us to remove an attendance entry associated with them. How we collect, use, retain, and delete this data is described in our Privacy Policy. By interacting with the Service, you consent to that collection and use.
11. Public Creator Profiles, Rankings, and Trophies
If you use the Service as a Broadcaster, some information about your activity is public by design. You should not use the Service if you do not want it published.
What is public. Your creator profile — including any biography, links, social handles and picture you add — together with statistics derived from the Events you run: number of events, categories, hours live, current and best streak, how many scheduled Events you kept, attendance and reaction counts, clips created, the trophies you have earned, and your position on our public leaderboard. Your follower and following lists are public, and following another creator is visible on both profiles.
How rankings work. Rankings and trophies are calculated from recorded activity using criteria we set and may change. We may recalculate, correct, withhold, or remove a ranking, trophy, or statistic at any time — including where a figure appears inaccurate, was produced by a fault, or was obtained in breach of these Terms. Rankings and trophies have no monetary value, are not property, are not transferable, and confer no entitlement.
Accuracy. Statistics are our best measurement of activity we observed. They are provided "as is" and may be incomplete or wrong, including where a third-party signal (such as Twitch's) was delayed or missing. Do not rely on them as an audited record.
Controls. You may edit or remove your profile content at any time, and you may opt an Event out of public discovery listings. Some records of a completed public Event may persist on shareable pages you or others have already shared.
12. User Content and Permissions
You may submit content such as Event titles, descriptions, images, links, creator-profile biographies, social handles, custom links, profile pictures, and other materials ("User Content"). You grant OneStarLive a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g., resize or reformat images), display, and distribute your User Content solely to operate, provide, and improve the Service and to display your Events across Service surfaces (including shareable event pages and overlays).
You represent and warrant that you own or have all necessary rights to your User Content and that it does not infringe or violate any third-party right or any law. We may remove or refuse to display any User Content at our discretion. Images you upload are screened automatically before storage, and an image that fails the check is rejected.
13. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks (excluding User Content and third-party marks such as Twitch's), is owned by OneStarLive and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service as intended. All rights not expressly granted are reserved.
14. Copyright / DMCA
Designated agent. Notices of claimed copyright infringement should be sent to our designated agent:

Sending a notice. Your notice must include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and enough detail to locate it; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act for the owner; and (f) your physical or electronic signature.
Counter-notice. If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address containing: your contact information; identification of the removed material and where it appeared; a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification; and your consent to the jurisdiction of the federal court for your district (or, if outside the United States, any district in which we may be found). We may restore the material as permitted by law.
Repeat infringers. We terminate the accounts of repeat infringers in appropriate circumstances, and may remove material or suspend access at any time.
15. Prohibited Conduct
You agree not to:
- violate any law, Twitch or third-party rule, or any right of another;
- use the Service to promote or facilitate harassment, doxxing, fraud, scams, hate, or illegal activity;
- misrepresent an Event, a goal, or what using Bits will achieve;
- inflate, manipulate, or fake activity to affect statistics, trophies, or leaderboard position — including running Events that are not genuine streams, leaving a stream marked live when it is not, or using automated or artificial interactions;
- impersonate another creator, or use profile content you do not have the rights to;
- interfere with, disrupt, overload, exploit, scrape, or gain or attempt unauthorized access to the Service or its data;
- circumvent any security, rate limit, or acceptance gate (including the Terms-acceptance requirement); or
- reverse engineer, decompile, or attempt to extract source code, except to the extent this restriction is prohibited by law.
16. Termination and Feature Changes
We may modify, suspend, limit, or discontinue any part of the Service at any time, with or without notice, including chat tools, automations, vote mechanics, scheduling flows, or analytics. We may suspend or terminate your access if we believe you have violated these Terms or used the Service in a harmful, abusive, or unlawful way. Sections that by their nature should survive termination (including Sections 6–8 and 12–21) will survive.
17. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free from data loss, or that it will be compatible with any particular device, browser, overlay, or Twitch configuration or change. No advice or information obtained from the Service creates any warranty not expressly stated here. Nothing in the Service is legal, financial, tax, or professional advice.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ONESTARLIVE AND ITS OWNERS, OPERATORS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, ANY EVENT, ANY USE, OR ANY BROADCASTER OR VIEWER CONDUCT — even if we were advised of the possibility of such damages, and regardless of the theory of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) US $100, OR (B) THE AMOUNT YOU PAID ONESTARLIVE DIRECTLY (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Because Bits are paid to Twitch and never to OneStarLive, Bits used are not amounts "paid to OneStarLive" for purposes of this cap.
Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
19. Indemnification
You agree to defend, indemnify, and hold harmless OneStarLive and its owners, operators, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your Events, User Content, or conduct; your interactions with any Broadcaster or Viewer; your violation of these Terms; or your violation of any law, Twitch or third-party rule, or third-party right.
20. Dispute Resolution
20.1 Informal Resolution First. Before starting any formal proceeding, please contact us at contact@onestarlive.com with a brief description of the dispute and allow 30 days for us to try to resolve it. Most problems can be settled this way.
20.2 Courts and Venue. If a dispute is not resolved informally, it will be brought exclusively in the state or federal courts located in California, and you and OneStarLive each consent to the personal jurisdiction of those courts. Either party may still bring an eligible individual claim in small-claims court.
20.3 Time to Bring a Claim. Any claim arising out of or relating to the Service must be brought within one year of when it arose, to the extent permitted by law.
21. General
Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including third-party platform outages (such as Twitch), internet or hosting failures, or acts of God.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be limited or reformed to the minimum extent necessary.
No Waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent; we may assign them (for example, in connection with forming a company or a business transfer).
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and OneStarLive regarding the Service and supersede any prior agreements.
22. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms and revise the "Last updated" date, and where practical we may require renewed acceptance (for example, before creating an Event). Your continued use of the Service after changes take effect means you accept the updated Terms.
